When you hear “crime,” you might think of major offenses like murder, arson, or rape. But even seemingly minor actions can lead to criminal charges. Shoplifting, trespassing, or vandalism may seem insignificant, but they have legal consequences.

While the penalties may not have the same severity, they can still impact your criminal record, affecting your life, employment, reputation, and relationships. It is crucial to understand what to do when accused of a crime. Here are some key points to be aware of when facing criminal accusations.

Your Rights

Remember, an accusation does not mean guilt – you are innocent until proven guilty and have rights as a defendant. For instance, the Fifth Amendment grants the right to remain silent, allowing you to refrain from answering self-incriminating questions. However, you must provide basic information, such as your name and address.

Another important right is the Sixth Amendment’s guarantee of legal representation, even if you cannot afford a lawyer. You also have the right to a speedy and public trial by jury, as stated in the Sixth Amendment. The court cannot indefinitely delay your trial, although the term “speedy” is relative.

Hiring a Lawyer

When accused of a crime, securing a lawyer is of utmost importance. The Sixth Amendment guarantees you this right. Even if you cannot afford a lawyer, the court will provide you with a public defender. However, remember that these public defenders often juggle multiple cases, limiting their time to devote to your case.

Given this reality, hiring a lawyer becomes a necessity. They can provide personalized attention to your situation, tirelessly working to defend your rights. While it may cost you significantly, it is worth every dollar.

Choosing The Right Lawyer

When choosing a lawyer, there are several critical factors to consider. These include their years of experience, specialization, and geographical region of practice.

Experience

A lawyer’s years of experience are an essential consideration for hiring. A seasoned lawyer will have a wealth of knowledge and practical experience, which is invaluable in navigating the complex legal landscape.

You can often tell a lawyer’s experience by the years they have been practicing law by the information they share on their website or professional profiles.

Specialization

Specialization refers to a lawyer’s focus area in law, which differs from experience. Specialization ensures a deep understanding of the laws, regulations, and procedures relevant to your case.

Like experience, you can determine a lawyer’s specialty by checking their bio, their firm’s website or simply asking them directly.

Geographical Region of Practice

The geographical region the lawyer practices in is of paramount importance. A lawyer familiar with the local courts, judges, and prosecutors can be a great asset. They will have a deep understanding of local laws and procedures and might even have relationships that can help in the negotiation process.

For instance, if you are facing a DUI charge in Richmond, a local Richmond DUI lawyer will be more aware of the local laws and legal landscape than an attorney from another state.

What to Expect from a Lawyer

“Engaging a lawyer doesn’t guarantee walking scot-free. But it does improve your chances of a better legal outcome because an adept lawyer leverages their expertise to potentially mitigate the severity of penalties,” says Attorney Karin Riley Porter of Virginia Defense Group.

This can be achieved by negotiating plea bargains, exploring alternative sentencing options, or striving to lessen charges for those carrying less severe consequences.
